BeJames website rules and services

  1. GENERAL
    1. The terms “we”, “us”, “Company”, “BeJames” and “www.bejames.com” refer to Rucksack B.V., a private company with limited liability under Dutch law. Rucksack B.V. is registered with the trade register of the Chamber of Commerce under number 75543702. Our VAT registration number is NL860318527B01. We are located at Burgemeester Thijssenstraat 2, 5437AW, Beers, The Netherlands.
    2. These general terms and conditions of BeJames apply to the BeJames gift voucher and all associated services that are made available directly or indirectly, both online and offline.
    3. By using the website www.bejames.com or any other sites or platforms relating to this product, the user – the purchaser / recipient – acknowledges that he has read, understood and agreed to these terms and conditions.
    4. We reserve the right to change these General Terms and Conditions unilaterally at any time. If this is the case, we will post these amended General Terms and Conditions on the website www.bejames.com as soon as possible.
  2. APPLICABILITY OF THESE TERMS AND CONDITIONS
    1. BeJames and its affiliated partners provide an online platform through the website www.bejames.com to make bookings for various types of temporary accommodation.
    2. Since BeJames does not sell temporary accommodation under its own name, from the moment you book, BeJames acts solely as an intermediary between you and the accommodation provider.
    3. BeJames will send the details of your reservation to the relevant accommodation provider and send you a confirmation email on behalf of the accommodation provider.
    4. Your booking is only final after receipt of the confirmation email.
    5. BeJames is responsible for the transaction process on www.bejames.com. As such, BeJames manages transaction disputes in case of problems with the payment process. If you have any further questions, comments or complaints about the booking, hotel or transaction that you cannot resolve directly with the hotel, please contact us.
  3. PRIVACY AND COOKIES
    1. We respect the privacy of all users of BeJames. Please refer to the Privacy and Cookies sections in the footer of the website.
  4. DEPENDENCE ON THIRD PARTY INFORMATION AND SERVICES
    1. The information we disclose in providing our services is based on the information provided to us by, but not limited to, accommodations and affiliated partners. While we will use reasonable skill and care in performing our services, we do not verify, and cannot guarantee that all information is accurate, complete or correct, nor can we be held responsible for any errors (including apparent mistakes and typographical errors), inaccurate, misleading or false information, any interruptions (whether due to repair, upgrade, maintenance, partial and / or temporary outage of our website or otherwise) or non-delivery of information.
  5. PAYMENT AND PRICES
    1. Payments are due immediately when ordering.
    2. Payments can be made with various payment methods available.
    3. Cash payments are neither possible nor permitted.
    4. BeJames payment processes are well secured.
    5. Payments and pending payments cannot be canceled or changed.
    6. Gift voucher transactions require 24 hours to process. As such, the purchased gift voucher code can be redeemed after 24 hours.
    7. All hotel prices on www.bejames.com are displayed including VAT and other taxes, unless stated otherwise on our website, the confirmation email or other (electronic) correspondence. BeJames gift vouchers are not subject to VAT.
    8. Orders of a business/commercial nature are usually paid by invoice payment. Orders paid by invoice payment will be shipped within five business days of receipt of payment. Please note that gift vouchers are not activated until the order has been paid. Please contact us for any questions or special requests.
  6. CANCELLATION OF AN ORDER
    1. All BeJames value codes are bearer instruments. Because BeJames value codes can be duplicated or shared with third parties after the sale and thus can be redeemed by a third party, canceling an order is not possible.
  7. VALIDITY OF A BEJAMES GIFT VOUCHER
    1. All BeJames gift vouchers and (remaining) balances are valid for two years after purchase.
    2. BeJames reserves the right at all times to block and / or deactivate any gift voucher whose payment has been canceled or not received in any way without further explanation. We also reserve the right if one or more bookings have been made with a BeJames gift voucher that has not been paid in full, to cancel such booking(s).
  8. EXCHANGE A BEJAMES GIFT VOUCHER
    1. BeJames gift vouchers are redeemable for all properties showing availability on www.bejames.com on your selected dates and location.
    2. BeJames gift vouchers are only redeemable at www.bejames.com. It is NOT possible to make your booking with a BeJames gift voucher directly with the hotel.
    3. When booking on www.bejames.com, the BeJames value will be deducted from the amount to be paid. In case the BeJames gift voucher is not fully used in one go, the remaining amount will remain valid for a new booking. If the booking is more expensive than the (remaining) value of the BeJames, the rest is to be paid by online payment.
    4. One BeJames gift voucher can be used per booking.
    5. No rights can be derived from special requests made when making the booking.
    6. After payment and / or exchange of the BeJames gift voucher you will receive the booking confirmation by e-mail. You can then print this booking confirmation and show it when you check in at the hotel. Please ensure that you have your ID with you at all times as the hotel may request it.
    7. It is NOT possible to exchange your BeJames gift voucher for cash or other funds.
    8. Under the Anti-Money Laundering Directive (AMLD5) adopted by the European Parliament and the Council, we reserve the right to conduct additional investigations or ask questions. We reserve the right to block or deactivate BeJames gift vouchers in the event of reasonable suspicion of fraud, money laundering or other criminal / illegal activities.
  9. GROUP BOOKINGS
    1. With your BeJames gift voucher you can book a maximum of 8 rooms online for the same accommodation and stay dates. If you want to book 9 rooms or more, please contact us. You may be required to sign a written contract and / or pay a non-refundable security deposit. If we determine that you have booked more than 8 rooms in total in separate reservations, we may cancel your reservations and, if applicable, charge you a cancellation fee without prior notice. If you have paid a non-refundable deposit, it will not be refunded.
  10. BOOKINGS FOR LONG-TERM STAYS
    1. With your BeJames gift voucher you can book a maximum of 28 nights for the same hotel, more is not allowed. If you wish to book more than 28 nights, please contact us. You may be asked to sign a paper contract and / or make a non-refundable deposit. If we determine that you have booked more than 28 nights in total in individual reservations, we may cancel your reservations without prior notice and charge a cancellation fee, if applicable. If you made a non-refundable deposit, you will lose your deposit.
  11. CANCELLATION OR CHANGES OF BOOKINGS
    1. You will find the cancellation policy on your booking confirmation, check the specific conditions there. If the booking can be canceled, please email your cancellation request along with your booking confirmation to [email protected]. The value of the canceled booking minus any cancellation fees will be reloaded on your BeJames gift voucher used to make the original booking.
    2. To change your booking, you must cancel your booking and then make a new booking.
    3. In case of no-show or absence from the booked accommodation without cancellation, you are not entitled to a refund.
  12. COMPLAINTS ABOUT THE ACCOMMODATION
    1. If you have any complaints about (your stay in) the accommodation, you should contact the accommodation directly. BeJames cannot be held liable for claims or complaints about (your stay in) the accommodation.
  13. FURTHER CORRESPONDENCE
    1. By completing a booking or by ordering a BeJames gift voucher, you agree that to receive an email that we can send you prior to your arrival date containing information about your destination and reservation, an email that we can send you after your booking and / or stay in which we invite you to send feedback, and an email in which we ask you to share your (travel) story and (travel) experiences without obligation via a blog / content on www.bejames.com.
  14. INTELLECTUAL PROPERTY
    1. All information and materials, including, but not limited to, software, texts, data, graphics, images, sounds, videos, logos, icons or html codes and other coding, located on www.bejames.com, may not be published, modified, copied, reproduced, or otherwise edited outside the www.bejames.com environment without our prior written permission. All such intellectual property rights (including copyrights) in the content, material and information on this website are owned by BeJames, unless stated otherwise. An infringement of the rights of this website is punishable. The intellectual property rights (including copyrights) in the content, material and information on this website are owned by BeJames, unless stated otherwise. No part of this website may be used or reproduced without the prior written permission of BeJames.
    2. If you provide relevant material (such as, but not limited to, content for blogs, vlogs, images, reviews) to BeJames or post on BeJames.com, we will handle it with care. BeJames is under no obligation to publish this material on www.bejames.com. By submitting any material in any form, you represent and warrant that the information is accurate and that the use of the content you provide will not violate any provision of these terms and conditions and will not harm any person or entity as well as that you will indemnify BeJames for all claims arising from content provided by you. You further disclaim all proprietary rights in such material.
  15. LIMITED LIABILITY
    1. To the extent permitted by law and subject to the restrictions set out in these terms and conditions, BeJames cannot be held liable for (1) the services provided or the products offered by the accommodation provider, (2) any inaccuracy with regard to the (descriptive) information (including rates, availability and ratings) of the property as made available on our website, (3) any punitive, special, direct or indirect or consequential loss, loss or damage, loss of production, loss of profit, loss of business, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (4) any damages (direct, indirect, consequential or punitive), losses or costs incurred, incurred or paid by you, arising out of, arising out of or in connection with the use, inability to use our website use or delay, or (5) for any (personal) injury, death, property damage or other (direct, indirect, special, consequential or punitive) damage, losses or costs suffered, incurred or paid by you, whether as a result of (legal) acts, errors, infringements, (gross) negligence, willful misconduct, omissions, non-performance, defective or late performance , misrepresentation, tort or strict liability by or attributable (in whole or in part) to the property (its employees, directors, officers, agents, representatives or affiliated companies), including (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

    1. Dutch law applies to all our services and products. All rights reserved.
